Lower Gwynedd Township reschedules meeting due to potential for Sunshine Act violation

A reorganization meeting of the Lower Gwynedd Board of Supervisors originally scheduled for January 3rd has been rescheduled to Friday, January 6th to avoid a violation of the Sunshine Act (Pennsylvania’s government transparency law).

On January 2nd, we were reviewing the public meeting schedule for several municipalities when we noticed that Lower Gwynedd Township had not posted the agenda for the January 3rd meeting. It is required to be posted to the township’s website 24 hours prior to the meeting. This requirement is rather new as it was signed into law in June of 2021.

As of 7:50 a.m. on January 3rd, the agenda had still not been posted so we inquired with the township whether the meeting would be rescheduled. We were told that the township was checking with the solicitor. The township sent out an email announcing the change to the meeting schedule at 3:02 p.m. You can view the agenda here.

Below is the notice from the township:

The Lower Gwynedd Township Board of Supervisors will reorganize on Friday, January 6th, 2023 at 6pm here at the Township Building. The organization meeting was originally scheduled for Tuesday, January 3rd, 2023 as per the 2nd Class Township Code, but due to the offices being closed for New Year’s Day, we inadvertently failed to post the agenda 24 hours in advance of the meeting. The agenda was posted this morning instead. In order to comply with the Sunshine Act, we are rescheduling the meeting to provide the proper notification. We apologize for the inconvenience this may have caused.
